The “Right-to-Know Law (RTKL),” Act 3 of 2008, effective January 1, 2009, provides for access to public information by legal residents of the United States. Requests for access to public records under the RTKL may be submitted in person, by mail, by e-mail, or by facsimile and addressed to the Open Records Officer.

REQUESTS

A written request for public records shall comply with the Pennsylvania Turnpike Commission’s (Commission) policies, process and procedures for requesting such records and shall identify or describe the records sought with sufficient specificity to enable the Commission to ascertain which records are being requested. Written requests shall also include the name and address to which the Commission should address its response.

The regular business hours of the Commission’s RTKL Office are 8:30 a.m. to 4:30 p.m., Monday through Friday, except holidays. Requests received by the RTKL Office after the close of regular business hours shall be deemed to have been received on the following business day. RTKL requests may be submitted on the form established by the Office of Open Records. The form may be found on the Office’s website at openrecords.state.pa.us.

FEES

The Office of Open Records shall establish fees for duplication by photocopying, printing from electronic media or microfilm, copying onto electronic media, transmission by facsimile or other electronic means or other means of duplication. Such fees may be found on the Office of Open Records website at openrecords.state.pa.us. The Commission will charge $.25 per page for duplication; $1 per copy for certified copies, when requested; and actual cost for postage, facsimile transmission, microfilm, or other media. The Commission will determine on a case-by-case basis reasonable fees for other necessarily incurred costs.

Prior to granting access in accordance with the RTKL, the Commission may require the requester to prepay an estimate of the fees authorized by the RTKL if the fees are expected to exceed $100. All applicable fees must be paid in order to receive access to the public record requested.
