Legislation (HB 119) would give the DOT Director the specific power to enter into an agreement with the Toll Road, Bridge and Tunnel Authority to privatize a road built in the future and to allow the authority or its designee to collect tolls on the road. This bill would:

Remove the existing prohibitions regarding bonded indebtedness and collection of tolls on certain tunnels and bridges that become part of the federal system.
Specifically give the authority the power to enter into an agreement with the DOT to build a toll road or to enter into a joint venture with a private party to build a toll road.
Allow the authority, with the approval of the DOT and any federal agency as necessary, to privatize roads built in the future and impose a toll for the use of the roads.

Legislation (HB 215) - Under existing law, there is no provision for the creation of separate toll road, bridge, and tunnel authorities for a county. This bill would provide for the creation, under the sponsorship of the Alabama Toll Road, Bridge and Tunnel Authority, a toll authority to provide financial and other support for a toll road in Montgomery County. It would provide for the powers and composition of the authority, and amend Section 23-2-143 of the Code of Alabama 1975, relating to the Alabama Toll Road, Bridge and Tunnel Authority. The amendment would call for allowance of the creation of a toll authority for construction of a road in Montgomery County and for the extension of I-85 within the state; and would provide for membership of the authority. This legislation is pending Committee Action in House of Origin 02/03/09.

Passed a Law in 04/07 that enabled Mississippi to enter into P3s for toll road and bridge projects. The State Senate has passed several bills for toll roads in the past, largely at the request of those in coastal areas where tolls are seen as the only viable funding source for necessary projects. This is the first time that the Mississippi House agreed to authorize tolls, however. The law authorizes P3s for the design, finance, construction, operation and maintenance of toll roads only in areas where other non-tolled transportation options exist, and does not permit tolling on existing roads. Toll rates are subject to approval by the contracting government entity (after public notice and hearings), and concession agreements may require revenue sharing with the State DOT. Solicited and unsolicited proposals are authorized. The law also limits the length of contracts with private partners to 30 years.

On 07/01/09 tolls at the Hampton Main Line plaza on I-95 increased from $1.50 to $2.00 for passenger vehicles and dual tire vehicles will increase by $1 per vehicle. The increase in the toll is expected to generate between $11 million to $12 million in additional revenue a year. The additional revenue will help fund the implementation of Open Road Tolling (ORT) at the Hampton Main Line Plaza. ORT Revenue generated will also go toward funding the $120 million transfer of a 1.6 mile stretch of interstate from the Portsmouth Traffic Circle to the I-95 bridge to the state Bureau of Turnpikes.

The NJ Turnpike Authority on 04/17/09 lowered price guidance for its planned issue of Build America Bonds, the new type of debt allowed under the federal stimulus bill. They cut guidance for the taxable bonds to 375 basis points over Treasuries from an original 387.5 basis points. They are planning to issue up to $1.25 billion of the new bonds and up to $500 million of tax-exempt debt. Build America bonds have become a hot way to finance state-funded construction. Build America Bonds, interest rates are subsidized by the U.S. government.

Two additional $0.25 increases at the main plaza are scheduled to occur in 2011 and 2012, bringing the charge to $1.50.
